摘 要:互联网购物已日益成为人们购物的重要方式,然而,部分经营者利用互联网信息传播迅速、受众群体庞大的特点,以不正当地人工删除差评行为来获取竞争优势。人工删除差评行为对于消费者决策、经营者竞争的显著消极影响,是对该行为进行反不正当竞争法规制的主要动因。人工删除差评行为的出现,从主体认定、行为认定、法律责任等方面对反不正当竞争法提出了挑战。针对这些挑战,应从多方面衡量人工删除差评行为的正当性、明确责任主体、适当加重相关法律责任等方面加强法律规制,以求达到有效规制人工删除差评行为、维护互联网交易平台正常竞争秩序的目的。Internet shopping has become an increasingly important way of life. However, some business operators, taking advantage of the fast spread information on the internet and the large audience, resort to manual deletion of negative comments in order to get competitive advantage, which has exerted significant negative impact on consumer decision-making and competitor operation, and is the main reason for legalization against such phenomenon. However, manual deletion of negative comments pose challenges to the anti-unfair competition law in respects like the determination of the offence and the subject of offence,and legal liability involved. Therefore, justification of such behaviors must be measured from various aspects; the subject of liability must be clarified, and enhanced legal liability must be applied in order to achieve effective regulation against manual deletion of negative comments and maintain normal competition order.
