司法拍卖房产能否适用限购政策的法理分析

摘  要:为了稳定房地产市场,我国各大城市广泛采取了住房限购政策。然而,限购政策与国家司法拍卖有关法律存在冲突,给房产司法拍卖执行活动带来了一定程度的冲击。笔者认为,房产司法拍卖是否适用限购政策不能"一刀切"。依据整体性法律观,要综合考虑有关法规、原则和政策,妥善加以解决。在有关法规与政府政策相冲突时,既要坚持保障民事权利的法律原则,也要兼顾维护公共利益的政策需要,在公共利益和当事人的民事权利之间取得适当平衡。In order to stabilize the real estate market,major cities in China are widely adopted a house purchase restric- tion policy.However,it is conflicted to national judicial auction law,and brings a certain degree of impact to judicial house auction activities.Whether judicial auction applying restriction policy or not,it cannot be solved a cut.On the basis of law as integrity,we should comprehensively consider the relevant regulations,principles and policies,and properly deal with it.We should not only adhere to the principle of protection of civil rights law,but also consider the policy needs to safeguard the interests of the public,and give attention to the fight balance between public interest and the civil rights.
