摘 要:杀邓析者何人?驷歂抑或子产,历来争论不止。《左传》记载邓析为驷歂所杀,而《吕氏春秋》《说苑》等文献明确指出子产杀邓析。从文献考证、史实辨析和文字训诂三个角度来澄清这一争论,可得出结论:子产与驷歂并非一人,"杀"邓析者是驷歂,而"诛"邓析者是子产。"诛"并非"杀",争论的出现正是因为混淆了这两个字的意义。其次是邓析因何被杀的问题。有论者认为,邓析是摇唇鼓舌、淆乱是非以谋私利的"讼棍"。事实上,司法与礼法、个人与权威以及逻辑推理与取譬思维之间的冲突,才是邓析被杀的深层原因。法家和名家通常被礼乐文化目为小人,而邓析兼有名家、法家的双重身份,必然为主流社会所不容。The extant materials yield two opposing views respecting the question who sentences Dengxi to death. By examining the historical records as well as retrieving the semantic variation of some key words synchronically, the author draws the conclusion that Zichan may only condemn Dengxi severely, but Sichuan kills Dengxi twenty years later. Furthermore, the author refutes the shallow opinion that Dengxi is a money- oriented lawyer who can only throw the country into disorder. The conflicts between the individual and the authority, the judicial administration and the patriarchal dan system are the incentives that lead to the death of Dengxi.
