论对公诉方案卷笔录的法律限制——审判中心主义改革视野下的考察

摘　　要：在推进以审判为中心的诉讼制度改革的大背景下,如何克服案卷移送制度以及案卷笔录中心主义的裁判方式所带来的问题已成为改革的关键。在案卷移送制度难以废除的情况下,为了减少案卷笔录可能带来的负面影响,应对其在审判阶段的使用加以严格的法律限制。这种限制主要表现在如下四个方面:对庭前法官接触案卷的范围进行限制,对庭前法官阅卷可能产生的预断进行限制,通过对案卷笔录证据能力的否定来限制其在法庭审理中的使用,通过集中审理原则的贯彻来限制案卷笔录对法官心证的影响。At the background of promoting the trial - centered reform of the procedural system, it is the key to overcome the adverse effects that the system of transferring dossiers and the trial mode eentralized on the files and dossiers bring in. In the case where the system of transferring dossiers can＇ t be abolished, the use of the files and dossiers at the trial stage should be limited as far as possible. And the limitation mainly focuses on the following aspects： limiting the scope of dossiers that the judge reviews before the court, limiting the judge＇ s prejudge after reviewing the dossiers, limiting the use of the files and dossiers at the trial stage by de- nying evidence competence, and limiting the influence of dossiers on the judge＇ s free evaluation of evidence by the principle of centralized trial.
