摘　　要：我国有组织犯罪的刑法立法进程大概可以分为三个历史阶段,即立法的探索阶段、立法的初成阶段和立法的完善阶段。纵观我国有组织犯罪刑法立法的演进过程,发现其呈现出犯罪形势、刑事立法、刑事司法相互影响的互动特色,这反映了随着对有组织犯罪观念的不断深化,我国刑事政策观念及刑事立法的不断调整的动态发展过程。回顾我国有组织犯罪刑法立法20年的演进,仍能发现其在立法模式、立法的前瞻性、立法的系统性以及刑事责任与刑罚配置等方面存在的较多问题。针对我国有组织犯罪刑法立法的缺陷,我国未来的刑法立法改革走向就是要总结既往立法和司法实践探索经验,正视立法存在的不足,不断从结构、制度和立法技术等方面加以完善,运用多元、能动、理性的总体立法方略构建完备的有组织犯罪刑法体系。The criminal law legislative process of organized crime in our country can be divided into three historical stages, namely, the exploration stage of legislation, the beginning stage of legislation and the perfection stage of legislation. Throughout the evolution of the criminal law legislation of organized crime in China, it is found that it has the interactive characteristics of criminal situation, criminal legislation and mutual influence of criminal justice, which reflects the constant adjustment and dynamic development process of criminal policy and criminal legislation with the continuous deepening concept of organized crime. When reviewing the evolution of China＇s organized crime criminal law in the past 20 years, it is still possible to find out many problems in the legislative model, the prospect of legislation, the systematism of the legislation and the criminal responsibility and the arrangement of penalties. With respect to the shortcomings of the criminal law legislation of organized crime in our country, the future reform of criminal law in our country is to summarize the experience of previous legislation and judicial practice, face up to the shortcomings of legislation, constantly improve them from the aspects of structure, system and legislative technology, etc., and utilize a multiple, initiative, and rational general legislation strategy to establish a comprehensive system of organized crime criminal law.
