公司利益视角下的国企分类规制

摘　　要：国有公司中,作为股东的政府的利益具有多元性、异质性和不确定性,国有公司利益也具有这些特点。作为股东的政府的利益可以通过参与模式和信托模式融入公司利益。应当重新确定不同类别的国企,并确定各自对应的履行出资人职责的机构,由履行出资人职责的机构动态调整国企功能。As the shareholder of the state-owned enterprises,the government has the interest with pluralism,heterogeneity and uncertainty.The state-owned enterprises also possess these characteristics.The interest of government can be reintegrated into the interest of corporate by the participation and the trust mode.Different types of state-owned enterprises should be reestablished and respective investor duty performing bodies should be determined.The organization which performs the responsibility of investor should dynamically adjust the function of the state-owned enterprises.
