摘　　要：在国家海洋战略全面开展的进程中,海上刑事犯罪的问题日渐突出,依法打击海上犯罪成为我国海洋司法领域面对的重要问题。我国正处在诉讼模式转型期,诉讼中心已经过渡到审判阶段,认定并处罚犯罪更加注重证据,对证据要求也更加严格,口供地位下降,实物证据变得至关重要。通过分析近年来发生的海上刑事案件发现:海上犯罪环境相对复杂,涉案问题和线索专业化程度高,侦查部门发现、认定、取证等案件处理程序存在较大困难。结合我国执法实际和国情并参考美国海岸警卫队执法经验,我国海上侦查部门办理刑事案件时,应完善侦查取证相关制度和程序,加强部门与区域沟通协调,保证程序正义的前提下提高侦查效率,使侦查获取的证据经得起辩方的质证。In the all-round conducting process of the National Marine Strategy,the problem of maritime crime is becoming more and more prominent,so it has become an important problem in the field of maritime justice in our country to fight against marine crime according to law.Our country is in the transition period of lawsuit mode,and the lawsuit center has already been transited to the trial stage.Therefore,the cognizance and punishment of crime are paid more attention to the evidence,and the request for evidence also become stricter,the confession status falling and the physical evidence becoming vital.Based on the analysis of the maritime criminal cases in the past years,it is found that the crime environment in the sea is relatively complex,the problems involved and the clues are highly specialized,and there are great difficulties in the case-handling procedure of investigation departments when finding,identifying and collecting evidence.Combined with the actual situation of law enforcement in our country and the law enforcement experiences of the US Coast Guards,our marine investigation department,when dealing with criminal cases,should perfect the system and procedure of investigation and evidence collection,strengthen the communication and coordination of departments and regions,improve the efficiency of investigation under the precondition of procedural justice,and let the evidence obtained by the investigation stand up to the defense's quality certificate.
