以审判为中心视域下侦查取证的新挑战

摘　　要：《关于推进以审判为中心的刑事诉讼制度改革的意见》必然将会从各个方面影响侦查取证工作。对于以审判为中心的刑事诉讼制度改革误读的澄清,知晓以审判为中心不是以法院为中心,这将会帮助我们领悟以审判为中心刑事诉讼制度下侦查取证工作面临的新要求、新挑战。对证据裁判原则的贯彻实施,重视实物证据的收集与提取,坚持非法证据排除规则,逐步完善取证程序,将会有助于推动以审判为中心的刑事诉讼制度改革。The Opinions on Advancing the Trial-centered Criminal Procedure Reform will affect all aspects of investigation andevidence collection work. The clarification of the trial-centered criminal procedure reform system will help us to understand thenew requirements and challenges faced by the investigation and evidence collection system under the trial centric system. Wemust carry out the principle of evidence judgment, pay attention to the collection and extraction of physical evidence, adhere tothe exclusionary rule of illegal evidence and perfect the procedure of collection of evidence, which will help to promote thereform of criminal procedure centered on trial.
