摘 要:我国《劳动合同法》对劳动合同的终止情形做了详细规定,却对劳动合同终止时间的确定毫无涉及,造成了在司法实践中劳动合同终止时间认定标准的混乱状态。因此,从实证和理论分析角度,对这一问题进行研究实属必要。本文从2016年1月至2017年6月的187份判决文书中,筛选出了24份研究对象,在提炼其观点的基础上对公司提前解散情形下的劳动合同终止日的本质进行了剖析,提出了判断劳动合同终止时间的细化标准,同时穿插论述了备案新规对于外资企业提前解散情形下的劳动合同终止日认定问题的影响。China's Labor Contract Law has detailed provisions on the termination of the labor contract, but the determination of the termination time is not involved, which led to the confusion about the standard of the labor contract termination time in judicial practice. Therefore, it is necessary to study this problem from the perspective of empirical and theoretical analysis. We screen out 24 research subjects from the 187 judgments during the period of January 2016 to June 2017. On the basis of refining their views , the paper dissects the nature of the termination time of the labor contract in the case of premature dissolution of the company, and puts forward a detailed standard to judge the termination time of labor contract. Meanwhile, it also discusses the infuence of the new regulations on the determination of the termination date of the labor contract in the case of premature dissolution of foreign enterprises.
