摘 要:我国人民陪审员制度实施效果欠佳,缘于缺乏权利认同。究其根本,是由于缺乏权利认同使得义务认同与权利保障的薄弱,导致人民陪审员制度异化为精英陪审、专业陪审和陪而不审。缺乏权利认同有民众观念和制度建构两个层面的原因。在试点改革的当下,人民陪审员制度应当摒弃革命根据地时期政治总动员的方式,转而注重权利保障和权利监督。人民陪审员制度的权利化改造,需要构建立体化的权利认同体系:成为人民陪审员,是公民的普遍性权利;选择、监督人民陪审员,是当事人的诉讼权利;实质性陪审,既是人民陪审员的审判权力,也是其个人权利。Due to the lack of rights recognition,the people's assessors system in our country is ineffective. The lack of rights recognition, which roots in people ~s conscience and system construction,leads to the poor of obiligation recognition and rights protection, catabolizing the system to elite jury, professional jury and paternity without trial. Under the background of the pilot reform, the people "s assessors system should abandon the way of Political mobilization which prevailed in Revolutionary base period, and lay emphasis or~ right protection and right supervision. The people "s assessors system should be reformed through right, which needs the construction of tridimensional right recognition system. Fine words, being people "s assessors are universal rights of citizens; choosing and supervising people Js assessors is every litigant's Procedural right; serving as an assessor substantively is not only people's assessors'Judicial power, but also their personal right.
