摘 要:随着数字技术的兴起和快速发展,新闻的传播渠道和运营模式发生巨大变革,由此也引发了一系列侵权乱象,相关主体利益矛盾更为突出。为对实践中可能存在的新闻类作品概念的认知错误正本清源,主张将新闻类作品作为规范的学理概念。新闻类作品的法律保护对于个人之创新激励、社会之秩序维护、国家之安全保护和国际之顺畅沟通均有着重要的价值和意义。然而数字环境下新闻类作品著作权法律保护之症结主要在于立法规定之不明与司法救济之不足,因此,应借助《中华人民共和国著作权法》第三次修改的契机,重塑新闻类作品的权利范畴、归属、限制与保护等方面的规则,以有效地缓解冲突,实现新闻类作品法律保护之本旨。With the rise and rapid development of digital technology,the dissemination channels and business models of news have undergone tremendous changes. As a result,a series of infringement and chaos have also been triggered. Interest conflicts between related parties have also been highlighted. In this context,this paper firstly clarifies the concept of news-related works that we assert shall be a normative concept for discussion.The protection of news-related works under Copyright Law has great significance for news-producers to create,social order to maintain,national security to safeguard and global world to communicate. In digital environment,main reasons resulting in failure of copyright protection for news-related works lies on the unclear legislation and insufficient judicial relief. Therefore,we argue that under the process of the third revision of Copyright Law of China,reconstructing regulations and rules of news-related works' copyright scope,affiliation,limitation,utilization and protection can be a fundamental solution.
