调解检察监督若干争议问题之再思考

摘　　要：2012年修订《民事诉讼法》时新增了对调解书的检察监督,即在第208条规定检察机关发现调解书损害国家利益、社会公共利益的,应当提出抗诉;对审判监督程序以外的其他审判程序中审判人员的违法行为,有权提出检察建议。这一规定就能否对调解进行检察监督作出了明确的回答,终结了"能否监督"的争议,但"如何监督"尚未解决,学理上对这一规定存在多种解读,实务中法院与检察院的观点与做法也时有抵牾。在梳理调解检察监督的法检冲突、学理争议的基础上,以检察机关依法履行法定监督职责为基点,围绕调解检察监督的对象是调解还是调解书,监督的目的是维护国家利益、社会公共利益等"两益"还是所有合法权益,以及调解检察监督的案件范围等重大争议问题,从程序与实体相结合的视角展开分析。When the Civil Procedure Law was amended in 2012, the procuratorial supervision over the mediation was added. That is, when the prosecutors find that conciliation statement harms national interests or public interests, they should lodge a protest. Which is ruled in 208th articl. In addition to someone who is in process of judgement supervision, who is in other trial procedures would commit an action that was outside the law, prosecutors have the right to put forward the Suggesting Right of the Procuratorates. This regulation make a specific answer whether prosecutors can conduct procura- torial supervision on mediation, and that ended the controversy about ＂whether or not＂, but, ＂how to do＂ is not resolved as yet. In academic theories, it has various interprets. And in practice, it also has different views and practice between court and procuratorate. Based on combing the conflict between court and procuratorate in mediation of procuratorial super- vision and theoretical arguments. Taking procuratorate are earnestly exercising their supervision as basic point, and revolv- ing the object of mediation of procuratorial supervision whether mediation or mediation statement. And whether the purpose of supervision is to maintained national interests and public interests ete ＂two interests＂ or all legal rights. And the scope of mediation of procuratorial supervision cases and other issues is hugely argued. Analyzing the above issues from the view of combine procedure and substance.
