摘　　要：波斯纳是70年代以来最为杰出的法律经济学家之一,他主要运用的两种知识资源是实用主义哲学和经济学。通过运用经济学的定量分析、定性分析工具,将实用主义哲学的观点贯穿在对旧的法的客观性理论的质疑和建构交谈意义上的法的客观性的过程中。尽管在如今社会构成多元化和不同质的时代,在法律问题的解决中特别是面临疑难问题时无法达成结论,但波斯纳确实为法律的学科构建和司法的具体实践提供了有益指导。Richard Allen Posner,one of most outstanding legal economists since the 1970s,using two kinds ofknowledge resources which are philosophy of pragmatism and economics mainly. Through the use of quantitativeeconomics analysis,qualitative analysis tool,it makes the perspective of philosophy of pragmatism through the process ofthe questions of objectivity in old laws and the construction of conversation objectivity of law. Although in today＇sdiverse social composition,it would be unable to reach a conclusion particularly faced with difficult problems in legalissues,but Posner does provide useful guidance for the discipline of the law building and practice of justice.
