卫生计生监管相对人黑名单管理制度若干问题研究与分析

摘　　要：卫生计生社会信用体系是通过对卫生计生行业从业机构、从业人员、服务监管相对人失信行为的记录、揭露、信息传播和预警,加强事中事后监管,解决信用信息不对称的矛盾,从而惩戒失信行为,奖励诚实守信,以促进卫生计生事业健康发展的管理手段。随着卫生计生信用体系建设不断地推进,与之相关的各项制度逐渐被制定并已推广实施。黑名单管理制度作为惩戒失信者的制度的建立,是管理部门进行信用监管和对被监管单位实施信用约束的重要抓手与途径。因其适用领域的广泛性,市场影响的普遍性以及推广方式的简易性,为各行业、各部门积极响应与应用,各行业各部门纷纷出台各自的黑名单管理制度。江苏省卫生计生系统拟出台监管相对人黑名单管理制度,作者通过对黑名单管理制度的内涵、背景、影响以及存在的问题进行研究和分析,提出建设性建议,为制度的制定提供理论参考。The social credit system of health and family planning is based on the recording, revealing, information dissemination and arly warning of the dishonest behavior of health and family planning of health industry practitioners, employees and supervised parties service regulation relative person dishonest behavior records reveal, information dissemination,and early warning, to strengthen the regulation of thingsin process and afterwards, and to solved the problem of credit information asymmetry, so as to punish dishonest behaviordishonest ACTS, reward honesty, promote the healthy development of health and family planning career health. With the development of the social credit system of health and family planning,the system of credit system construction has been gradually developed and implemented. The construction of b Blacklist management system as a disciplinary paper system of punishing dishonest behaviorarrangement, is an important gripper and access of in the credit supervision and implement important gripper and way of credit constraints., because Because of its applying in the field of universalitywide application, the universality of market impact, and ease the simplicity of the way of promotion, by the positive response of various industries, many industries and departmentsdepartments and application,have introduced their blacklist management system. Health and family planning system in jiangsu province proposed plan to construct its ownregulation the blacklist management system,. the Tauthor through the research and analysis of the connotation, the background, the influence and the existing problems of to the blacklist management system connotation, background, influence and study and analysis of existing problems, the author puts forward constructive suggestions, to provide theoretical reference for system.
