摘 要:我国近年在公共事务领域发生了多起为社会所广泛关注的艾滋病患者反就业歧视案件,集中反映了艾滋病患者这一弱势群体的就业权被侵害的程度。保障艾滋病患者的就业权,是保护其人权的需要和"维稳"的需要。尽管在我国的宪法、法律法规和其他规范性文件中都能找到反艾滋病患者就业歧视的规定,但却不明确,且有些规定还存在违宪违法的情况;而专门的反就业歧视法律的缺失,致法律存在空白——这些都非常不利于保障艾滋病患者的就业权。鉴此,应建立完备的反就业歧视法律保障体系、制定合理的艾滋病患者从业范围,并对艾滋病患者进入公共事务领域进行规制。In recent years, many cases of anti-employment discrimination against AIDS patients occurred in the field of public affairs in China,which arose widespread social concern. This is the concentrated reflection of th eviolation of AIDS patients' employment rightsas a weak group. Protecting AIDS patients' employmentright is the need to protect their human rights and the need to maintain social stability as well.Although related regulations of anti-employment discrimination against AIDS patientscan be found in the constitution, laws, regulations and other normative documents in China, no special anti-discrimination employment law in our country,the relevant legal provisions are not clear, the law is blank, and some rules are evenillegal and unconstitutional.This is very detrimental to AIDS patients' employment rights. Therefore, we should establish a comprehensive legal safeguard system for anti-employment discrimination, establish a reasonable scope of work for AIDS patients and regulate the entry of AIDS patients into public affairs.
