行政司法的正义追求及其实现的伦理思考

摘　　要：行政司法本质中蕴含着丰富的正义价值追求:以制度化的形式保障正义实现、保证公共权力实施的正义性、保证审判过程和结果的公正性;平等地对待每一个当事人、为公正诉求提供实现途径等。但是,在司法实践中,行政司法正义价值的实现面临着诸多伦理困境:制度设计上的权力扩张倾向导致制度正义缺失、运行程序的不正义倾向导致不当行政裁决、行政司法主体的不当作为导致行政相对人利益受损等。保证行政司法正义价值实现的伦理路径包括:行政司法制度设计应体现正义价值、行政司法权运行程序应符合法定程序、健全行政司法主体道德约束机制等。Administrative judicature contains rich value pursuit of justice on its nature:it ensuring the realization of justice in the form of institution,guaranteeing justice in applying public power and keeping justice both on the process and the result of adjudgments;Treating each party equally and providing them the feasible path to realizing justice.However,the realization of the value of justice on administrative judicature faces many ethical dilemma in juridical practice:the inclination of the power expansion in institution designing leads to the lack of institutional justice,the injustice inclination in the trial procedure causing improper administrative adjudication,and the improper actions of the Administrative Judicature subject impairing the interests of its counterpart.There are several ethical routes to ensure the realization of justice on administrative judicature:embodying the value of justice in its institution design,complying with legal procedure in the operating procedure of administrative judicial power and perfecting the moral restraint Mechanism of Administrative Judicial subject.
