摘 要:劳务派遣作为一种特殊用工形式,以其低成本、低风险受到了用工企业的追捧,但同时企业的逐利性和劳动者的弱势地位也导致了劳务派遣中被派遣劳动者权益屡被侵害。因此,国家应从立法层面进一步明确劳务派遣用工范围,提高劳务派遣单位准入门槛,加大对违规单位的监管和惩罚力度,同时增强劳动者法律意识和维权意识,改善被派遣劳动者权益受损现状。As a special means o f labor service, labor dis-patch is warmly welcomed by the enterprises that hire the dispatched workers because o f its low cost and risks. On the other hand, since the enterprises try to pursue the greatest profit, the rights of the dispatched workers, who are in vul-nerable status, are repeatedly impinged. Hence, in order to improve the status o f the rights and interests of the dis-patched workers, relevant laws and rules should be made to further clarify the scope of labor dispatch, to improve the operation of labor dispatch providers , ,to access "threshold” and severely punish those who violate the law and disci-pline. At the same time, the legal awareness of the dis-patched workers should be enhanced; they should be encour- aged to safeguard their rights when needed.
