摘　　要：行政诉讼起诉期限延误制度体现着诉权保障与司法对行政活动谦抑、尊让的价值权衡。新《行政诉讼法》第48条进一步完善了行政诉讼起诉期限延误制度,增设了起诉期限扣除情形。起诉期限扣除程序应当以申请而启动,申请要件包括耽误事由客观存在、法定起诉期限已经过、两者间存在因果关系、障碍消除后十日内提出。关于起诉期限扣除或延长申请的审查与认定,法院应以立案受理通知书的形式予以支持,以裁定驳回起诉的方式予以否定。起诉期限扣除情形中,法院只能对申请是否成立作出审查与认定;起诉期限延长情形中,法院既可就是否成立作出审查与认定,亦可基于一定标准对延长期限作出裁量。对于当事人在延误情形上的"错误申请",法院应当给予一定的释明和指导。The system of delay in the duration of administrative litigation prosecution embodies the trade-off between the protection of litigation right and the respect for administrative activities. Article 48 of the new Administrative Procedure Lawfurther perfected the system of delay in the time limit for ad- ministrative litigation prosecution and added the deduction of the time limit for prosecution. The procedure of deduction of the time limit for prosecution should be initiated by application. The application require- ments include the objective existence of delay, the deadline of legal prosecution, and the causal relation- ship between the two. With regard to the review and determination of the application for deduction or ex- tension of the period of prosecution, the court shall support it in the form of a notice of acceptance of the case and denied it in a manner that determines the dismissal of the complaint. In the case of deduction of the time limit for prosecution, the court can only review and determine whether the application has been established or not. In the case of an extension of the period of prosecution, the court may review and de- termine whether the application is established or not, and may also decide on the extension of time limit based on certain criteria. The court should give some interpretation and guidance on the ＂wrong application＂ of the parties involved in the delay.
