患者知情同意权与和谐医患关系的建构

摘　　要：知情同意权是患者的一项非常重要的权利,落实患者知情同意权对于构建和谐的医患关系具有重要意义。但是在患者知情同意权贯彻过程中往往会产生医患冲突,原因主要有:医患双方对知情同意权认知上的差异;医方漠视患者知情同意权,未充分履行告知义务;医方知情同意的告知方式欠妥;医疗技术水平的局限导致对患者知情同意权的侵犯;医疗卫生资源供需矛盾和分配不合理;患方医学知识缺乏,难以理解医务人员的告知;关于患者知情同意权的法律法规不完善。落实患者知情同意权构建和谐医患关系的路径有:提高医患双方的道德素养;加强医患之间的沟通交流,注重对患者的人文关怀;提高医务人员的技术水平;合理分配卫生资源,逐步实现分级诊疗;修改和完善关于患者知情同意权的法律法规。Patients＇ right to informed consent is important to construct the harmonious doctor - patient relationship. But it always generates conflicts between doctors and patients. The main reasons are as follows： different cognition on patients＇ informed consent right between doctors and patients, physicians＇ ignorance on patients＇ informed consent right, inappropriate way of infor- ming patient＇ s consent right, violation against the patients＇ informed consent right caused by the limitation of medical technology, imbalance of supply - demand and distribution of medical care resources, patients＇ misunderstanding of the right due to lack of medical knowledge and insufficient law and regulation. The path to enact patients＇ informed consent right and construct harmoni- ous doctor - patient relationship includes improving the moral standard of patients and physician, strengthening the communication between doctors and patients, paying more attention to the humanity care on patients, increasing the expertise of medical profes- sionals, allocating medical resources reasonably, implementing classified medical care, and revising the law and regulation of pa- tient＇ s informed consent right.
