我国GATS下承诺与中外合作办学市场准入法律问题

摘　　要：我国在《服务贸易总协定》下提交的服务贸易具体承诺表中作出了"将允许中外合作办学"的市场准入承诺,从而使得我国中外合作办学受到服务贸易多边规则的约束。尽管我国加入《服务贸易总协定》已16年之久,我国中外合作办学市场准入的法律规则仍存在着符合我国GATS下的承诺义务问题。这既涉及到国际条约在我国的适用问题,同时造成潜在的争端解决风险。我国正在修改完善《中外合作办学条例》及其实施办法,要以此为契机,对违反我国GATS承诺义务的内容进行相应的修订和完善。As China made commitments in Chinese Schedule of Specific Commitments under the GATS that"joint schools will be established",Chinese-foreign Cooperative Education has been subjected to the GATS.Although China has been a member of GATS for 16 years, there are still some inconsistency and conflicts between regulations concerning Chinese-foreign Cooperative Education and the specific commitments of China under the GATS. It is related to the application of treaties, and makes a potential risk of other members to recourse to Dispute Settlement Understanding(DSU). As China now plans to revise the Regulations of the People's Republic of China on Chinese-foreign Cooperative Education and its Implementation Measures, it is urgent to make amendments to those regulations too.
