刑法解释的基本逻辑——以目的解释为中心

摘　　要：文义是法律解释之开始,尊重文义也应是适用法律之基础前提。但由于文义解释本身所存在的"文不达意"之痼疾,极易招致匪夷所思之后果。《刑法》之根本目的系为保护法益,而在适用文义解释无法得出妥当的结论时,以法益保护原则为基础的刑法目的解释之闪亮出场则显得尤为必要。就此而言,围绕法益保护原则,构建以刑法目的解释为中心的刑法解释体系,也应当成为刑法解释之基本逻辑。唯其如此才能使得刑法解释因入情入理而变得更加令人心悦诚服。但同时,刑法目的解释之适用还应受到罪刑法定原则的严格限制,从而避免"前门驱狼,后门进虎"的场面发生。Language is the beginning of legal interpretation,and respect of letter should also be the base of the justice.However,due to this phenomenon that sometimes language fails to express the meaning,literal interpreta-tion may lead to unthinkable consequences.The fundamental purpose of the criminal law is to protect the legal in-terests,and when the application of the literal interpretation is unable to draw appropriate conclusions,criminal tel-eological interpretation based on the principle of the protection of legal interests of law is very necessary.For that matter,adhering to the principle of the protection of legal interests,the construction of system of teleological inter-pretation should be the basic logic of criminal interpretation system.Only by this way can the criminal interpretation become more convincible and reasonable.But at the same time,the application of criminal teleological interpreta-tion should also be strictly limited by the principle of legality in order to avoid some other disadvantages.
