福建省医疗卫生行政处罚案件及对策分析

摘　　要：目的分析福建省医疗卫生案件行政处罚与医疗卫生监督工作开展情况,了解医疗机构执业行为,为更好地开展医疗卫生监督执法、规范医疗服务工作提供依据。方法对2016年以及部分2015年福建省医疗卫生监督以及医疗卫生行政处罚工作开展情况的数据进行描述性分析和χ2检验。结果 2016年福建省各地共查处各类医疗案件768件,监督覆盖率为86.43%,其中厦门的医疗卫生监督覆盖率和医疗卫生行政处罚率在全省各地市中最高。医疗机构违法违规执业案件与无证行医案件主要是在卫生监督检查中发现的,其中医疗机构"使用非卫生技术人员从事医疗卫生技术工作"的违法事实占总案件的43.1%。无证行医案件以个人非法行医为主,首次因非法行医被行政处罚的案件共413件,占91.37%。结论行政处罚案件中警告案件数快速增长导致罚款率下降,说明各级卫生计生监督机构加大了对医疗机构执法力度和行政处罚力度。2016年因政策变化,莆田等个别地区对被监管医疗卫生单位开展监督覆盖率大幅度下降。应对"使用非卫生技术人员从事医疗卫生技术工作"与"诊疗活动超出登记范围"的违法行为开展重点监督,重点打击个人非法行医,向社会公布投诉举报方式,营造社会监督氛围。Objective To analyze health administrative penalty cases and medical supervision works carried out in Fujian, understand practice of medical institutions and provide basis for the development of health supervision, law enforcement and standardized medical services. Methods Descriptive analysis and chi -square test was adopted to analyze the data of medical and health supervision and medical and health administrative penalties in Fujian province in 2016 and part of 2015. Results A total of 768 medical cases were investigated in Fujian province. The coverage rate of supervision was 86. 43% and the highest coverage of medical, health supervision and administrative penalties was in Xiamen city. The cases of illegal prac- tice and unlicensed medical practice in medical institutions were mainly found during health supervision and inspection. A- mong them,the illegal fact that medical institutions ＂use non-health technical personnel to do medical and health technical work＂, accounted for 43.1% of the total cases. There were 413 cases of administrative punishment for illegal practice of medicine for the first time, accounting for 91.37. Conclusion The rapid increase in the number of cases of administrative warning punishment resulted in a drop in the rate of fine, indicating that health and family planning supervision agencies at all levels have increased the enforcement of law and administrative penalties on medical institutions. Due to the policy changes, the coverage of in supervise to the medical and health units decreased in Putian and other individual regions in 2016. The focus of the supervision should be the illegal activities of ＂using nonhealth technical personnel to engage in medical and health technical work＂ and ＂diagnosis and treatment activities beyond the scope of registration＂. It should be placed on cornbating the illegal practice of medicine by individuals, through the announcement of complaints to the public and create a social supervision atmosphere.
