危险驾驶罪犯矫正效度实证研究——以安徽省467例危险驾驶罪判决量刑为切入点

摘　　要：醉酒驾驶作为危险驾驶罪的主要类型之一,自《刑法修正案八》实施以来,案件数量较多,判处监禁矫正与社区矫正的情况也较为复杂和多元。为解决矫正效度问题,选取了467个数据样本,按照审理法院,被告人性别、年龄、文化程度、职业;案发时间段、驾驶车辆类型、是否发生事故、是否先行被采取羁押性强制措施、血液酒精浓度、拘役期限、是否适用缓刑、缓刑考验期、罚金数额等多个维度进行整理归纳,录入SPSS系统,进行了研究,并以矫正效度视角对危险驾驶罪量刑提出了建议。Drunk driving, one of the main types of dangerous driving, is of great amount since the amendment 8 of criminal law, and its sentences of imprisoning correctioii and community correction are complicated, 467 samples are selected and the data are analyzed by SPSS from the dimensions of the trial court, the defendant gender, age, culture level, occupation; time of the crime, vehicle type, the accident, custody ahead of compulsory measures, blood alcohol concentration, detention period, probation, probational period and fine amount, etc.. And suggestions of dangerous driving crime sentencing from the perspective of correction validity are put forward.
