摘 要:我国行政履行判决的规范设计与制度运行呈现出诸多不足之处:一方面,司法实践仍将撤销重作判决适用于行政机关拒绝履行法定职责案件中;另一方面,因立法的单一性和片面化导致缺乏必要的司法审查强度,使司法对于行政权的监督力度不足,从而影响当事人获得实效、完整的救济。问题的症结源于我国在撤销诉讼一体主义下缺乏对行政履行判决的特殊性的正确认识以及行政机关不履行法定职责案件司法审查的必要程序装置。借鉴域外立法例完善履行判决相关制度建设以克服撤销中心主义,构建多层次司法审查强度,同时加强补充相关理论的准备和指导性案例的指引。The execution of judgment's rules design and system operation in our country,The application of "refusal to perform " has not been completely resolved because of judicial interpretation. In practice, there are still cases where the revocation judgment is applied to cases where the administrative organ will refuse to perform its legal duties. Due to the unity and unilateralization of legislation,substantive referees lack the necessary judicial review strength. Making the judicial supervision of administrative power insufficient and affect the parties to obtain effective and complete relief. Uniformity and one-sidedness also make our country lack the necessary judicial review of the administrative performance of judgments. The crux of the problem stems from our country lacking a correct understanding of the particularity of the execution judgment under the law of withdrawal litigation and procedures necessary for judicial review of cases where administrative agencies do not perform their legal duties. Learning from the Cases of Extraterritorial Legislation and Perfecting the Implementation of the System Related to the Judgment to Overcome the Centralism,Constructing multi-level judicial review intensity. At the same time,strengthen the guidance for preparation and guidance cases that complement relevant theories.
