网络安全法若干基本概念辨析

摘　　要：网络和网络安全是网络安全法的基本概念。由于该法在选取基本概念的中文名称时存在固有缺陷,导致该法在英译时无法采用合适的译名,这两个概念的使用现在无法与国际接轨。网络空间、网络空间安全、网络空间安全态、网络空间犯罪这四个概念是ISO/IEC 27032:2012的逻辑起点。未来网络安全法如果更名为网络空间安全法,改以网络空间和网络空间安全作为其逻辑起点,以在中文语境下外延已经拓展过的网络空间安全作为其核心概念,则既可以使其自身建立在严谨、周密的技术基础上,给其规制未来出现在"网络空间"中的新问题预留空间,也有助于构建科学的网络空间安全法逻辑体系。A law should be self-consistent. However, the Network Security Law of China has not fulfilledself-consistent. The contents of personal information protection and illegal information control are not includedin the extension of “network security” defined by the Network Security Law. The International Standards of ISO/IEC 27032：2012 define four terminologies about cyberspace, cybersecurity, cybersafety and cybercrime. If takingthese definitions as the logical starting point, we can clearly distinguish cybersecurity from the other five easilyconfusedterminologies, including information security, application security, network security, internet securityand critical information infrastructure protection. Thus, we can construct the logic system of cybersecurity law of China, which meets the requirements of self-consistent.
