摘　　要：本文通过对我国医师在特殊诊疗活动中说明义务法律制度存在的不足进行探讨,分析其原因,并对我国现阶段下完善医师在特殊诊疗活动中说明义务的法律制度进行思考,以期能够为后续研究提供参考。以促使医师充分履行说明义务,维护患者的自主决定权,避免医疗纠纷,推动医学发展进步。This article mainly discussed the （laws of the legal system of the physician demonstrative obligation in the special clinical activities , analyzed the reasons of its defect, and considered to perfect our physician demon- strative obligation law system in the special clinical activities at present in our country. In order to provide references for subsequent research, further encourage physicians adequately fulfill demonstrative obligation, maintain the self- determination of patients, to avoid medical disputes, and promote the development of medical progress.
