行政诉讼法修改后行政法领域遗留问题解决方法研究

摘　　要：2015年行政诉讼法的修改结果基本符合司法领域的预期,相对于1990年的行政诉讼法有相当大的突破。然而,新法修改也存在着诸多不成熟的地方,在行政法领域遗留了一些问题,有待进一步解决。对此,结合行政诉讼实践情况,分析行政法领域尚待解决的遗留问题,并提出建议,为行政诉讼法的再度完善提供有价值的参考。The revision result of the administrative procedure law in 2015 is basically in line with the expectation of the judicial field, having made a considerable breakthrough compared with the administrative procedural law in 1990. However, there still exist many immature areas in the revision of new law and some leftover problems in the field of administrative law, which needs to be solved further. In this regard, based on the practice of administrative litigation, this paper analyzes the remaining problems in the field of administrative law and puts forward some suggestions to provide valuable reference for the improvement of administrative procedure law.
