摘 要:《最高人民法院关于审理环境民事公益诉讼案件适用法律若干问题的解释》第1条确立了法律规定的机关和有关组织作为民事公益诉讼的主体资格。《民事诉讼法》和《环境保护法》分别明确了检察院和社会组织作为诉讼主体的条件,但仍不足以解决森林生态损害诉讼的基础性、专业性和复杂性问题,有必要明确规定将森林生态环境监督管理部门作为诉讼主体。现行法框架下或可通过类推适用和体系解释等方法,解决实务中森林生态环境监督管理部门主体资格的法律依据问题,但仅为权宜之计,未来立法中仍有必要明确规定其在森林生态损害公益诉讼中的主体地位。Article 1 of Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Environmental Public Interest Cases stipulates that empowered government agencies and organizations are the subject of ecological and environmental public interest litigation. Furthermore, Civil Procedure Law and Environmental Protection Law clarifies respectively the conditions of procuratorate and social organizations as the subject of the litigation. However, it is not enough to solve the fundamental, professional and complex problems in ecological public interest litigation. In existing legal system, it is possible to solve the problem by applying analogy and system interpretation, but in the future, it is necessary to stipulate the subject qualification of forestry administrative departments.
