工程款优先受偿权应用难点及对策研究

摘　　要：首先介绍工程款优先受偿权及其应用情况,然后阐述工程款优先受偿权的应用难点,最后结合典型实例,总结出原则上不得放弃工程款优先受偿权、放弃欠款以外部分的工程款优先受偿权和有条件地放弃全部工程款优先受偿权三种建议。This paper first introduces the priority compensation right for engineering funds and its application,and then expounds the engineering application difficulties of the priority compensation right for engineering funds,and finally combined with the typical example,sums up three suggestions,including not allowing to give up the priority right of repayment of project funds in principle,giving up the priority of repayment of the project part other than the arrears,and giving up the right of priority of the whole project.
