摘　　要：公安机关刑事执法办案责任制是在党的中央文件改革决定中明确提出的议题,即要完善"主办侦查员办案责任制,落实谁办案谁负责","实行办案质量终身负责制和错案责任倒查问责制"。本文从阐释办案责任制的制度背景出发,从权力运行的本质、责任承担的具体形式角度分析办案责任制的责任性质,论证追责原则与归责原则,厘清办案责任制的追责与免责范围,并进一步探讨追责机构及具体程序相关问题。The documents of decision on reform from the Central Committee of the Communist Party of China explicitly put forward the issue on the responsibility system for case-handling of criminal enforcement of law by public security organs, namely, improving "the responsibility system for responsible investigator, implementing the rules that the person who handles the case shall be responsible for this case" and "carrying out the lifelong responsibility system for case-handling quality and the retroactive accountability system for misjudged cases". On the basis of illustrating the background of the responsibility system for case-handling, this paper analyzes the nature of responsibility of this system from the perspective of the essence of exercising power and the specific mode of assuming liabilities, explains the principle of accountability and the principle of attributing responsibility, clarifies the scope of accountability and liability exemption of the responsibility system for case-handling, and further makes relevant discussions on accountability organs and specific procedures.
