非诉调解协议司法确认程序的实践误区及其矫正

摘　　要：我国《民事诉讼法》规定的非诉调解协议司法确认程序的功能在实践中未得到很好的发挥,与其运行存在误区息息相关。非诉调解协议司法确认程序的适用对象范围存在违法扩大的误区,这与最高人民法院不遵守依法解释的原则以及司法确认案件的管辖法院过于顺从、依赖司法文件、司法解释密不可分。人民调解协议是当事人合意解决纠纷的结果,对其进行司法审查体现法官心证和裁判的过程较少,确认人民调解协议效力的裁判文书因此被列入不上网公开的范围之内,并不妥当。此类司法确认案件被误当成小微案件,导致其考核权重的整体科学性低下。为理性矫正实践中的误区,非诉讼调解司法确认程序的适用对象范围应恪守法律限定主义,司法确认案件的裁判文书应全面详尽地上网公开,司法确认案件之考核权重的确定应采用省域标准。The function of the judicial confirmation procedure has not been brought into full play in practice, and it is closely related to the mistakes of its operation. The scope of the judicial confirmation pro- cedure is illegally broadened, which is inseparable from the Supreme People＇ s court＇ s failure to comply with the principle of legal interpretation and the court of jurisdiction is too compliant and too heavily relying on judicial documents and judicial interpretations. The people＇ s mediation agreement is the result of the parties＇ consensual solution to disputes, and there is less process to reflect judicial review and the judges＇ free evaluation of evidence. Therefore, the judicial documents confirming the effectiveness of the people＇ s mediation agreement are improperly excluded from the scope of publication through Internet. The judicial confirmation ease is mistaken for small and micro cases, which leads to its overall low weight in the court＇ s work performance. In order to correct these mistakes in practice, the scope of the judicial confirmation procedure should be strictly complied with the doctrine of legal restrictionism. The judicial documents for judicial confirmation should be published on the Internet in a comprehensive and detailed way. The weight it takes to evaluate the court＇ s performance should adopt a provincial standard.
