摘 要:影响毒品市场运行的因素,以及毒品犯罪者对禁毒刑事政策的回应,是我国禁毒刑事政策调整的现实依据。基于此,我国禁毒刑事政策在理念层面应从国家本位调整为国家·社会双本位犯罪治理理念,从严惩个案调整为控制毒品市场犯罪治理理念。我国禁毒刑事政策在具体调整层面,实施对象应当从犯罪人转为集体与市场;实施手段应当是刑事手段与社会手段相结合;适用上,严打转为控制毒品市场、重刑惩毒转为刑罚轻缓化。The enactment and adjustment of drug policy is based on factors which influent illicit drug markets, and the reaction of drug offenders. In light of this, the idea of drug policy should be adjust to crime control pattern based on both of nation and social, and drug market control. In terms of specific adjustment, the individual-centered object should be transformed to collective-centered or market-centered object. The measures should be the combina- tion of criminal sanction and social measures. Crackdowns should be reformed to regular investigations, and severe punishment should be modified to combining punishment with leniency.
