摘 要:2018年中央一号文件提出宅基地"三权分置"的表述未采用法学上的权利概念,该政策在落地实施前必须进行从政策语言到法学语言的转换,以确保该项改革举措的政策目标得以实现为前提,明确其法律内涵,并进行相相应的制度设计。本文结合农村宅基地制度改革试点地方的实践探索,阐释宅基地"三权分置"政策的初衷和意蕴,探讨其法律内涵和实现途径,并对其具体制度设计提出建议。No.1 document enacted by the CPC Central Committee in 2018 proposed to implement " Three-Rights Separation" of homestead.But the names of rights mentioned in this document do not correspond to the existing rights in law.Before the implementation of this policy,we should transfer the policy language to legal language,clarify its legal connotation,and develop specific rules,to ensure that the reform will be implemented by the rule of law.Based on the reform experimentation on homestead carried out by local governments,this article explores the original intention and implications of the "three rights separation" policy for homestead,discusses its legal connotation and legal ways to achieve it,and makes recommendations on its specific institutional design,including the names and structure of the three rights,the power and effect of the three rights,the conditions and procedures for "Three-Rights Separation" of homestead,etc.
