摘　　要：调查性侦查措施概念的提出,系对经济犯罪侦查中慎用强制措施的理念回应,其作为特殊的制度安排具有重要的理论研究意义。近年来随着经济犯罪形势日益严峻,经侦部门的执法环境亦呈现出复杂化的趋势。如何在办理经济犯罪案件的过程中准确适用侦查措施,对于推动侦查机关执法规范化、文明化尤为重要。调查性侦查措施作为此次立法修改所提出的新概念,应正视其理论地位,对概念内涵进行学理辨析,把握其理论张力。在明确其概念内涵与性质的基础上,对应不同的措施种类设计相应的司法适用原则和程序控制规则,并通过内部自律的犯罪嫌疑人确认规则以及外部他律的程序性控制进一步细化、完善调查性侦查措施的条文体系,形成法律程序与侦查实践的联系纽带,从而实现措施运用的法制化与实践运作的规范化的统一格局。The concept is a conceptual response to the careful use of investigative measures,and investigative measures have important theoretical research significance as a special conduct. In recent years,more and more economic crimes have occurred,and the law enforcement environment of economic crime investigation departments has also shown a trend of complexity. How to accurately apply investigative measures in the process of handling economic crime cases is particularly important to standardize and civilize the law enforcement of investigative agencies. Investigative measures,as a new concept proposed by this legislative amendment,we should pay more attention to its theoretical status,and analyze meaningful content,and clarify its theoretical significance. On this basis,the corresponding judicial application principles and procedural control rules are designed for different investigative measures,and by criminal suspects＇ confirmation rules during the investigation activities and procedural controls outside the investigation activities to further refine and improve relevant legal provisions of investigative measures,and then form a balance between legal procedures and investigation practices. Finally to achieve a unified pattern between the legalization of measures and the standardization of investigation practice.
