西南少数民族地区城乡接合部的基层自治研究——以法治价值观为视角

摘　　要：中国城乡接合部是在城市化背景下产生的,城乡接合部的问题具有很强的现实意义。西南少数民族聚居地区对国家成文法的接纳度长期以来都处于较弱的程度,在全面推进依法治国和十九大胜利召开的背景下,西南少数民族地区在城乡接合部基层治理方面,也要重视法律治理的手段。基于相较习惯法、村规民约和一般地方性法规的优势,应考虑利用完善少数民族自治法规体系的途径来促进对西南少数民族地区城乡接合部的治理。利用好少数民族自治法规的立法权和变通权,融入社会主义法治的价值理念和基本原则,促进城乡接合部基层治理的法治化,为民族团结、平等、共同发展提供良好的制度保障,弘扬法治精神,彰显时代担当,为法治中国立下新的标杆。The urban-rural joint part of China is produced under the background of urbanization, and the problem of the urban and rural integration is of great practical significance. The country＇s statutory acceptance of southwest ethnic minority area have long been in a weak degree, in promoting the rule of law and the 19 th national congress of the communist party of China was successfully held at the background, the southwest minority＇s area in urban-rural fringe of grassroots governance, also should attach great importance to the means of legal governance. Given that it is better than common law,village regulations and general local regulations, should consider using perfect minority autonomous laws and regulations system of ways to promote the integration of urban and rural areas in southwest minorities regions. Make good use of the legislative power of ethnic minority autonomous regulations and flexible, integrated into the value concept of socialist rule of law and the basic principle, promote the integration of urban and rural areas at the grass-roots level of governance under the rule of law, for national unity, equality, mutual development provides the system guarantee of the good, carry forward the spirit of rule of law, reveal age bear, to set a new benchmark in China under the rule of law.
