论国际竞争中立规则建构的正义维度

摘　　要：国际竞争中立规则的建构离不开以正义为基础的价值目标。缺失正义维度的竞争中立规则,不仅无法在国际经贸交往中实现公平的秩序环境,而且更可能在很大程度上引发缔结主体间的利益冲突与不信任感,从而导致规则难以有效运行,甚至是"破产"。以拉德布鲁赫公式作为竞争中立规则正义性的基本标准,展开对TPP中竞争中立核心条款的分析与评判,从现实的竞争中立规则创制实践中去探索正义的理念,为各缔结主体在国际经贸交往环境中建构相对完善之竞争中立规则有所裨益。The construction of international rules of competitive neutrality is based on the justice as its object. Rules of competitive neutrality without justice shall not form a harmonious and fair legal order in international economic cooperation,even produce more benefit conflicts and distrust among countries, which leads to the end of running the rules. Taking Radbruchsche Formel as the fundamental criterion of justice, there may be beneficial subjects to develop relatively perfect competition neutrality rules in the international economic and trade exchanges environment by analyzing and criticizing core clauses about rules of competitive neutrality of TPP, and to explore the concept of justice from the reality of competitive neutrality rules created practice.
