摘　　要：刑事司法中涉案财物保管与处置乱象频发。分析背后原因,并比较官方部分对策、试点折中模式,从规范、中立、高效、信息化等角度长远考虑,为保障证物不变、保护财产权,应在实体上建设跨机关保管机构,虚拟上配套建设专门的信息管理平台,实现专门机关与该平台在涉案财物管理领域安全对接。其理论基础为涉案财物证据方面的"鉴真"与"保管链条"理念,诉讼权力合理分配与财产权保护,节省司法资源、提升诉讼效率;技术支持为互联网平台及确保信息"有限推送"的网闸设备。该保管机构应隶属于中立的单位,建议由政府公务仓代管;应定位为保管为主、执行为辅,并确立保管时效制度;明确其与专门机关间的权责及监督机制,依托网络平台下保管机构的建设,创设涉物司法若干新制,完善财产权保护与救济制度。There are many problems in custody and disposal of property involved in criminal procedure,frequent in chaos,in the law enforcement and judicial process. Analysising the reasons of problems and comparing official strategies,pilot compromise model,from aspects of standardization,neutrality,efficiency,informatization and for preservation and protection,a long-term solution is construction of cross-organ custody institution based on Internet Platform,realizing the specialized organs connected to information intranet of the institution. Theoretical justification are concept of ＂authentication＂,＂chain of custody ＂,the protection of property rights and reasonable distribution of powers of the custody and disposal,saving judicial resources and improving the efficiency of litigation; Technical foundation include internet platform and＂limited transmission of information＂under the protection of gatekeeper. It is recommended the institution belong to neutral department,under the government official warehouse; taking custody as the core and execution to complement,establishing the custody limitation system; clearifying powers and responsibilities between specialized organs and institution,as well as supervision.On the ground of construction of custody institution based on Internet Platform,a series of new mechanisms of law enforcement and judicial process of property involved in criminal procedure are created,and better protection and relief for property rights.
