浅析检察机关民事行政法律监督职能的履行

摘　　要：随着国家监察体制改革试点的启动,职务犯罪侦查权的行使主体发生了转移,检察机关如何做出改变,打造检察工作新的亮点,是值得我们思考的问题。文章从当前民事行政法律监督实践出发,通过分析民事和行政法律监督需要遵循的基本原则,从如何完善检察建议、突破案件来源瓶颈、建立公益司法保护机制、强化与监察委员会的交流沟通四方面提出建议,充分发挥民事行政监督职能。With the pilot reform of national supervision system startup,the exercising body of duty crime investigation right has been transferred,which is worthy of thinking about how the procuratorial organs make a great change and create a new lightspot in procuratorial work.Starting from the current practice of civil administrative legal supervision,the article put forward the proposal from such four aspects as how to perfect the procuratorial advice,break through choke point of the case sources,establish the public welfare judicial protection mechanism and strengthen communication with supervisory committee by means of the analysis of the basic principle needed to be followed by civil and administrative legal supervision,so as to play a fully function of the civil administrative supervision.
