浅论悬赏证据的证据能力和证明力

摘　　要：以悬赏证据的证据能力和证明力为主要论证对象,从我国的取证制度证明该制度产生的土壤及合理性,从合同法角度论证其合法性。如果悬赏收集的证据符合关联性、客观性和合法性,即可认定其具有证据能力,反之则予以排除。Taking the evidence ability and proof capability of reward evidence as the object of demonstration,this paper proves the soil and rationality of this system from the perspective of our country＇s forensics system and proves its legitimacy from the perspective of contract law.If the evidence collected by reward meets relevance,objectivity and legitimacy,it can be identified as having proof capability and on the contrary,it will be excluded.
