摘　　要：法治对产权改革具有重要的作用。法治既能够约束政府行为,减少政府对经济的任意干预;法制又能约束经济人的机会主义行为。通过法制的这两个经济作用来研究法治对产权的影响,并通过法治对产权界定、产权保护产生作用的机理,得出法治是产权界定、产权保护以及产权交易的坚强后盾以及坚实基础。健全的法治能够促进产权改革顺利进行,为产权改革奠定坚实的法治基础,从而实现产权法治化。The rule of law plays an important role in property rights reform. The rule of law can restrain the government＇s behavior to reduce the government＇s arbitrary intervention in the economy. It can also restrain the opportunistic behavior of an economic man.Through the two economic functions of the rule of law, the impact of the rule of law on property rights is studied. The mechanism of the role played by the rule of law on the definition of property rights and property rights protection are analyzed. The results show that the rule of law is the strong backing and a solid foundation to the definition of property rights, property rights protection and property rights trading. A sound rule of law can promote the smooth progress of property rights reform, lay a solid foundation for property rights reform, and thus realize the rule of law in property rights.
