录音录像替代刑事简易程序庭审笔录探讨

摘　　要：最高人民法院出台的《关于人民法院庭审录音录像的若干规定》突破了对纸质法庭笔录的规定,推进民事庭审记录方式的改革。初步实践表明,我国适用简易程序审理的刑事案件,特别是其中可能判处3年有期徒刑以下刑罚的轻微刑事案件,完全可以用庭审录音录像替代法庭笔录。借鉴国内外经验,我国有关立法应当确定庭审录音录像为法定法庭记录的方式之一,并逐步明确落实庭审录音录像的操作、存储、查阅、责任等规定。A number of regulations issued by the Supreme People＇s Court on the recording and recording of the court hearing of the people＇s court have broken through the regulations on the written record of the paper court and promoted the reform of the way of civil trial records. Preliminary practice shows that the criminal cases that are applicable to simple procedures in our country, especially the minor penalties which may be sentenced to 3 years of imprisonment, may be minor. In criminal cases, the court record and video can be used to replace the court record. With reference to the domestic and foreign experience, the relevant legislation in our country should determine the recording of the court hearing and video as one of the legal records, and gradually make clear the operation, storage, inspection and responsibility of the court hearing and video.
