摘 要:公平竞争审查制度作为规制行政垄断行为的新兴制度,其在全国范围内实施已达22个月,该制度的实施既有清理出部分限制、排除竞争政策措施的良性效果,同时也存在诸多不足,具体包括"自我审查"效果不够理想、咨询机制及第三方评估机制未得到充分适用、审查案例信息公开的规范性和及时性有待提升。通过审查案例的实证考察可以发现公平竞争审查制度实施受制的深层原因,即激励机制缺位、审查流程不健全、互动性不足以及监督机制不完善。公平竞争审查制度在我国的实施要取得显著成果还面临诸多障碍,接下来的障碍克服工作仍然艰巨且意义重大。As a new system of regulating administrative monopoly, the fair competition review system has been implemented nationwide for more than 22 months. The implementation of this system has both the benign effect of removing some restrictions and eliminating the competition policy measures, while there are also many deficiencies, including the lack of satisfactory effect of "self-censorship", the insufficient application of the consultation mechanism and the third-party evaluation mechanism, and the normative and timely improvement of the disclosure of case information. Through the empirical investigation of the cases, it can be found that the deep reasons for the implementation of the system of fair competition examination are the absence of incentive mechanism, the imperfect review process, the lack of interactivity and the imperfect supervision mechanism. It is still difficult and significant to overcome that obstacle to the implementation of the fair competition review system in our country.
