论孕妇分娩方式选择的伦理基础

摘　　要：具有绝对医学指征的孕妇或其近亲属拒绝剖宫产手术,在生命第一的原则下,医方仍有强行实施手术的法律余地。具有相对医学指征的孕妇若拒绝剖宫产手术,医方应尊重其决定,实施密切观察下的助产服务。对于无剖宫产医学指征的孕妇,相关政策与医疗机构应进行层层深入地引导,使其自愿选择自然分娩方式,若其仍反复执意要求剖宫产手术,医方应遵从其意愿。建议细化医学标准,完善运行机制;增强引导力度,尊重孕妇选择,进一步完善孕妇分娩方式选择机制。For the pregnant women who have absolute medical indications or their close relatives refuse to undergo cesarean section,under the principle of ＂life first＂,doctors still have legal leeway to enforce the operation. If pregnant women with relative medical indications refuse to undergo cesarean section,the doctors should respect for their decisions and implement the midwifery service under close observation. For the pregnant women without medical indication of cesarean section,the relevant policies and medical institutions should guide in depth to make them choose the way of natural delivery voluntarily. If they still insist repeatedly the requirement of cesarean section,the doctors should comply with their wishes. It is suggested to refine medical standards,improve operating mechanism,strengthen the guidance,respect the choice of pregnant women,and further improve the choice mechanism of delivery mode for pregnant women.
