查办非法集资犯罪案件中涉案财产保全问题研究

摘　　要：查办非法集资案件的过程中,既要全力以赴破案抓人,也要最大限度追赃挽损,涉案保全是追赃挽损的前提和基础。经济社会发展,科技进步和法治进程推进,给涉案财产保全工作带来了成本增加、财产保值增值难度加大、企业经营易受影响、对外债权难于实现等新挑战。对此,应集中分析固有涉案财产保全在理念、手段、机制等方面存在的深层次问题,并在办案理念、机构完善、机制建设、制度创新、法律把握等多个方面采取有针对性的解决措施,以提升追赃挽损质量、效率和效果,实现"让人民群众在每一个司法案件中都感受到公平正义"的目标。In investigating unlawful fundraising cases, focuses should be kept on not only capturing criminals, but also getting funds back and retrieve the losses, which should be based on property preservation. Progresses in society, economy, science and rule of law have posed new challenges to property preservation, including increasing difficulties, corporates＇ proneness to effects and realization of creditors＇ rights. As such, it is advised to analyze deeply-hidden problems in terms of ideas, methods and mechanisms of property preservation. Pertinent measures should be taken in ideas of investigation, perfection of departments, mechanism design, system innovation and use of law.In this way, quality, efficiency and effects of retrieving losses can boost and realize the goal that fairness and justice are visible in every case.
