摘　　要：家事审判改革涉及诸多方面的内容,诸如裁判理念、诉讼程序、审判机构、管理考评等,而诉讼程序的改革应当系此次改革最为核心之内容。当前,试点法院围绕家事诉讼特别程序的构建进行了系列探索实践并取得一定成效,但综合以观,其对家事诉讼程序的具体设计仍缺乏系统性,且实际操作差异较大。基于此,本文从立法规制和司法实践两个层面对家事诉讼特别程序的现状进行审视,并借以"现实运行、程序保障、诉讼模式及域外借鉴"等四重维度对家事诉讼特别程序构建之必要性做出论证,以此为基准,在明确构建家事诉讼程序基本规则之同时对该项程序进行具体设计。Family trial reform involves many aspects, such as the concept of adjudication, litigation procedures, judicial institu- tions, management evaluation and so on, and the reform of litigation procedure should be the core content of this reform. At pres- ent, the pilot court has carried out a series of exploration and practice in the construction of family proceedings special procedures, and achieved some results. However, the comprehensive design of family proceedings is not systematic and the actual operation is quite different. Based on this, this paper examines the status of the special procedures of family proceedings from the two aspects of legislative regulation and judicial practice, and demonstrates the necessity of the construction of special procedures of family litiga- tion by the dimensions of ＂practical operation, procedural protection, litigation mode and extraterritorial reference＂. Then, accord- ing to the basic rifles for the construction of family proceedings, the specific design of the procedures is discussed.
