碎片化权威主义下协同治理的司法路径——以“中国政府采购第一案”为例

摘　　要：部门本位主义和碎片化权威结构长期束缚国家治理的协同能力。针对碎片化权威主义理论，学界曾提出社会力量参与政策协同的修正版，构建了“共识型决策”的替代模型，也探讨过如何克服协同失灵和构建整体性政府。然而，既有研究都局限于行政部门之间以及行政部门与社会力量之间的互动。文章超越既有视域，探讨法院如何作为社会力量参与政策协同的制度化渠道，指出一条政府协同治理的司法路径。文章以“中国政府采购第一案”为反常案例，考察司法体制如何协调发改委和财政部之间的政府采购管辖权之争。研究发现，司法程序正在成为公民维权的重要渠道，法院力量在政策制定过程中逐渐增大，并开始影响核心政府决策，成为“碎片化权威主义”结构中新兴的协调力量。Departmental selfishness and the fragmentation of the authoritative structure have always been restricting national gov- ernance capacity. With regard to the theory of fragmented authoritarianism, scholars have put forward the revision of social forces to participate in policy coordination, and build an alternative model of ＂consensus decision＂, and discuss how to overcome co - failure and build a holistic government. However, most studies are confined to the interaction between executive branches or be- tween the executive and social forces. This article goes beyond the existing sight in order to find a judicial way and discuss how the court becomes a social force participating in policymaking. This paper chooses ＂the first case of Chinese government procure- ment＂ as a deviant case, and try to find how the judicial system coordinates the NDRC and the Ministry of Finance in the govern- ment procurement jurisdiction. This paper concludes that the judicial process is becoming an important channel of civil rights, and that the power of the court gradually increases in the process of policymaking, starts to influence the core government decision - making and becomes the emerging coordination force in the fragmented authoritarian structure.
