民国时期象贝纠纷案评析

摘　　要：1933年浙江鄞县堇江有限责任贝母运销合作社成立后,与宁波药行合作,导致象贝价格节节攀升,最终引发上海国医药界的替代风潮。纠纷案中双方争论的焦点在于合作社限制生产政策和价格上涨是否违背了此前达成的协议。围绕象贝纠纷,合作社、宁波药行、上海国医界、上海国药界、种植户之间关系错综复杂。各垄断集团挥舞公益的大棒,从其自身利益考量,形成对最底层农户的共同剥夺。Since the establishment of Jinjiang Fritillaria Transportation and Sales Co-operation Company Limited in Yinxian,Zhejiang,it has co-operated with medicine houses in Ningbo.Price of fritillaria surged and eventually triggered a trend of fritillaria substitution in Traditional Chinese Medicine field in Shanghai.In this dispute,the focusing point of argument was whether the policy of limiting output and increase of price violated the agreement achieved.The relationships among the company,medicine houses in Ningbo,Traditional Chinese Medicine doctors and medicine dealers in Shanghai,and growers of fritillaria were complicated.In the name of public interest,monopoly groups together were in fact exploiting growers for their own benefit.
