国外虐童行为治理的法律透视

摘　　要：虐待儿童是普遍存在的全球性社会问题,通过对国外在立法、司法、执法等层面的虐童行为治理方式进行透视,可发现在法律体系方面,一些国家基本形成了体现正义与秩序的立法价值、法律主体宽泛、行为界定清晰、治理结构多元的虐童行为治理法律体系。在司法救济方面,一些国家建立了专门审理虐童行为的机构、确立了守持切适的刑罚裁量标准。在行政支持方面,一些国家建立了完备的强制报告制度、强大的社会性防控保障体系和儿童福利保障制度。防控虐童行为发生、提升预防虐童行为发生治理能力水平,建立系统而完善的虐童行为治理法律体系是基本的制度保障。Through the analysis of foreign child abuse legal systems, this passage try to provide legal experiences on prevention of child abuse. The western developed countries have formed relatively perfect legal systems of child abuse which include the justice and order legislative value, the broad legal subjects, the clear behavior definition and diversification governance structure. On the judicial relief side, the specialized agencies and appropriate standards of punishment for child abuse have been established. And on the administrative side, the mandatory reporting system, the effective social system and child welfare system guaranteed the rights of child. To prevent and control child abuse, it is essential to improve the governance capacity and establish a systematic and perfect legal system.
