摘 要:环境行政公益诉讼是时代发展的产物。法律赋予检察机关提起环境行政公益诉讼的原告资格不论是理论上还是实践中都有其合理性,在正当当事人理论的内涵不断发展,"私权制约"暴露出的弊端越来越明显的当下,检察机关凭借其自身的诉讼优势,充分发挥其法律监督作用,在为期两年的试点工作中取得了一定成效。但同时也存在诸如司法地方化、案件来源单一、证明责任缺失和诉讼成本负担不合理等一系列问题,为了促进这一制度更好地发展,必须有针对性地规划出完善路径。Environmental administrative public interest litigation is the product of the development of the times.The plain- tiff qualifications given by law to the procuratorial organs to initiate environmental administrative public interest litigation are reasonable both in theory and in practice.With the continuous development of the connotation of the legitimate party theory,the drawbacks exposed by the "restriction of private rights" are becoming more and more obvious.The procurato- rial organs ,by virtue of their own litigation advantages ,give full play to their laws.The role of law supervision has made considerable progress in the two-year pilot work.But at the same time,a series of problems have emerged,such as the challenge of judicial localization,the single source of cases,the lack of burden of proof and the burden of litigation costs. In order to promote the better development of this system,it is necessary to plan a perfect path.
