法律如何调整变化的社会——对“以不变应万变”思维模式的诠释

摘　　要：复杂多变的社会经常会对依法办事的思维模式提出挑战,因而很多人主张引入其他社会规范,甚至更复杂的语境因素来弥补法律规范的单调性缺陷。然而,这存在着使人们的思维陷入以复杂调整复杂的危险。社会关系本就很复杂,如果再引入更复杂的社会规范、语境因素等,法律规范可能会失去权威地位;如果任凭简单的依法办事思维模式蔓延,又会导致机械司法、执法的盛行。如何克服简单依法办事的缺陷,系统、准确、恰当的法律思维模式是十分重要的理论与实践议题。面对复杂多变的社会,法律调整的基本模式是"以简约应对复杂""以不变应万变,万变不离其法",只有这样才能使法治得到最大程度地实现。法律调整社会"以不变应万变",这并不是说法律在运用过程中不发生任何变化,而是在尊重法律权威,恪守法律的原则、价值、精神等因素的前提下实现"持法达变"。A complex and ever-changing society often challenges the thinking mode of doing things according to law.Therefore,many people advocate the introduction of other social norms and even more complicated contextual factors to compensate for the monotonous defects of legal norms.However,there is a danger that people＇s thinking will be complicated by complicated adjustments.Social relations are inherently complicated.If more complex social norms and contextual factors are introduced,legal norms may lose their authoritative status;if simple thinking mode of doing things in accordance with law is spread,it will lead to the prevalence of mechanical justice and law enforcement.How to overcome the defects of simply doing things according to law,we need systematic,accurate and appropriate legal thinking,which is a very important theoretical and practical issue.In the face of a complex and ever-changing society,the basic mode of legal adjustment is＂to cope with complexity with simplicity＂and＂to cope with changing events by sticking to a fundamental principle or policy＂.Only in this way can the rule of law be maximized.Law regulates a society by ＂coping with changing events by sticking to a fundamental principle or policy＂,which does not mean that the law does not change in the process of application.Instead,＂certain legal norms can be changed legally＂on the premise of respecting legal authority and abiding by the principles,values,and spirit of the law.
